Presettlement funding business
It is common for people to think that the media has it right when it comes to lawsuits — if you read the papers you can easily think that lawsuits are a big ripoff by greedy lawyers and their clients.
Nothing could be further from the truth.
Yes, there are frivolous lawsuits. But look at the facts. There are 16 million civil actions brought in state courts each year. The ones that are frivolous or get settled quickly leave the court. What's left isn't a handful, but several million. These may eventually settle. Mostly the plaintiffs, the victims, get some money.
I would agree that our system needs a bit of reform. But that is neither here nor there. Let's look at some cases.
A doctor botches a surgury and leaves a sponge in the person's body. Now, is that victim of something like this being frivolous?
Here's another. Someone gets drunk, gets in their car and smashes into you. You break your ankle, your collarbone, and your wrist. You pee blood for a week due to internal injuries. You must go week after week for physical therapy, and you wake up all night in pain each and every night. During the day, you hobble around in agony quite often. Is your lawsuit frivolous?
I could go on and on. There are reasons that people bring lawsuits. And lawyers fund these lawsuits out of their own pocket.
So the fact is, the media loves a good "man bites dog" story. So they report a few silly lawsuits but don't report on the normal ones. You know, this holds true for everything the media reports. The chances of getting shot by your own gun at home is lower than the chances of a toddler drowning in a bucket of water someone carelessly leaves around the house. But the media focuses on the weird and unusual. So the adolescent finding a gun and accidentally shooting his friend gets the press. Sadly, the more prevalent drowning death may be reported in a local paper on page 30, if at all.
So don't think that lawsuit victims are being greedy and aren't deserving. Now, when you are doing presettlement funding, you are helping these people pay their living expenses so they can make ends meet. Sometimes this is very hard for them. So when you are in the pre settlement funding business, you can know that you are helping people and in fact helping society, while you make a few bucks.
And that's not a bad thing.
